Cayman Health Practice Amendment 2026 lets Cabinet set standards

The Cayman Islands Parliament passed the Health Practice (Amendment) Bill, 2026, letting Cabinet impose binding standards on every registered practitioner, from prescribing to clinical research. A second amendment and a wider health law overhaul followed.

For two decades, professional standards for doctors, nurses, pharmacists and allied professionals in the Cayman Islands have been written profession by profession, in the codes each Council publishes under the Health Practice Act4. That changed in 2026. On 30 April the government announced that Parliament had passed the Health Practice (Amendment) Bill, 2026, which amends the Health Practice Act (2026 Revision) so that Cabinet can make regulations prescribing overarching standards of professional practice for every registered healthcare practitioner1.

What the amendment changes

The government describes the Bill as the first formal route to consistent, legally binding standards across all professions1. The subjects Cabinet's regulations may cover include professional responsibilities, licensing, scope of practice, consent and capacity to consent, prescribing and handling of medicines, clinical trials and research, patient safety, and trust, honesty and integrity1. Councils keep their role in writing profession-specific codes, but where the two conflict, "the Cabinet's standards will prevail to the extent of that inconsistency"1. The release adds that the Bill fulfils a 2018/19 undertaking to the Public Accounts Committee to develop a national healthcare standards framework1.

The public consultation opened on 31 March 2026 and ran until 11:59 p.m. on 28 April 20262; the consultation page said the Bill "seeks to enhance current legislation aligning it to international best practices"3. The government said the framework would also strengthen safeguards in areas such as consent, safeguarding, digital communication and scope of practice2. "The health system we build today will serve the Cayman Islands for decades to come," the Minister said2.

How standards are enforced under the Health Practice Act

The amendment builds on enforcement tools already in the Act. Under section 35 of the Health Practice Act (2026 Revision), each Council must publish a code of standards of professional practice, and a registered practitioner "shall comply" with it. Under section 36, a Council that finds a practitioner unfit, negligent, dishonest, convicted of a criminal offence or in breach of the code may censure, impose licence conditions, suspend a licence for up to two years, or have the name removed from the register; suspensions and removals are published in the Gazette4. Section 9 already bars a facility manager from permitting clinical trials without the Health Practice Commission's prior written consent4.

That last point shows how Cabinet standards may interact with existing guidance. In January 2026 the Health Practice Commission published standards for appraising trial applications, requiring written informed consent, indemnity cover, Good Clinical Practice training and reporting of serious unexpected events within 24 hours11. A Cabinet standard on clinical research would sit above such guidance.

The second amendment and the wider overhaul

On 27 July 2026 the government launched a programme of legislative reform covering a Public Health Bill, an Environmental Health Bill, a further Health Practice (Amendment) Bill and a Tobacco (Amendment) Bill. "This programme of legislative reform is our vision for the future of health in these Islands," Ms. Ebanks-Wilks said5. The Health Practice (Amendment No. 2) Bill, 2026 lets professional Councils set up sub-committees to help carry out their statutory duties; one early use is moving the Ruth Eleanor McLaughlin School of Nursing to local oversight under the Nursing and Midwifery Council. Its consultation opened on 31 July and closed on 25 September 20267. Radio Cayman reported on 1 September that the bills had been published for a 28-day legislative consultation; "Over the past four weeks, we have heard directly from people across all three islands about these proposed reforms," the Minister said6.

The regulator is also changing how it works. The Department of Health Regulatory Services launched an online renewal portal for practitioners in October 202510, publishes practitioner lists for each Council, and issued updated requirements for new Medical and Dental Council applications on 3 June 20269. One major piece remains outstanding: the Pharmacy Act, 2024, which would modernize the rules on importing, prescribing and dispensing medicines, is still listed as not in force812.

What it means for physicians in the Cayman Islands

For practitioners, the practical shift is that the rules of conduct will no longer come only from their own Council. Once Cabinet makes regulations, standards on prescribing, consent and research will apply across professions, and Council codes must yield where they conflict1. Breaches will be handled through the same disciplinary machinery that already allows suspension or striking off4. Physicians who prescribe, run aesthetic or wellness services, or take part in research should watch for the first set of Cabinet regulations, since the subjects listed for them include prescribing and handling of medicines, consent, and clinical trials and research1.
